Asbestos
The U.S. EPA Asbestos Hazard Emergency Response Act (AHERA) under the Federal Code of Regulations 40 CFR 763.93g(4) requires that building occupants be notified annually of the presence of asbestos in the building and the availability of the Asbestos Management Plan.
All Beaufort County School District buildings, except for May River High School, River Ridge Academy, and Pritchardville Elementary, contain some amount of building products containing asbestos. The Management Plan identifies the types and locations of asbestos in the building, and identifies inspections, sampling data, and response actions taken by the district.
A copy of the Management Plan is available for review in the school office or at the district's main offices located at the District Employee Service Center, Operations Department, 2900 Mink Point Boulevard, Beaufort, SC 29902. Booster Clubs, PTOs & PTAs
The Beaufort County School District requires that all PTO’s, PTA’S, Booster Clubs, and other support organizations submit two copies of the Booster Club form to your school principal, every year, by October 31. An updated copy of this form should be submitted at any point during the school year if any of the report information changes.

FERPA
Gavin's Law
Gavin's Law (H.3583) is legislation that makes sexual extortion, the act of blackmailing someone using sexually explicit images or videos, a felony offense and an aggravated felony if the victim is a minor, vulnerable adult, or if the victim suffers bodily injury or death directly related to the crime. In 2022, 17-year-old Gavin Guffey was a victim of sexual extortion, resulting in him taking his own life.
The bill reads in part, "Local school districts shall collaborate with the State Department of Education, the South Carolina Law Enforcement Division, and the Attorney General’s office, as appropriate, to implement a policy to educate and notify students of the provisions of this act which includes adequate notice to students, parents or guardians, the public, and school personnel of the change in law."
The South Carolina Department of Education has recommended that school districts incorporate the requirements of Gavin’s Law into the Erin’s Law curriculum and provide age-appropriate instruction on the dangers and consequences of sexual extortion to satisfy the requirements for student notification. The BCSD is implementing the South Carolina Department of Education’s recommendations.
The BCSD has updated Administrative Regulation 17 – Health Education which includes Gavin’s Law. The BCSD is committed to maintaining a learning environment free from intimidating or harassing behavior of any kind, including sexual extortion. In keeping with this commitment, the BCSD prohibits any student, staff, or third parties from engaging in any behavior that would satisfy the definition of sexual extortion or aggravated sexual extortion as described in state law.

Parent Right To Know - Title I
The federal education law put in place by the Elementary & Secondary Education Act (ESEA) requires that all parents in a Title I school be notified and given the opportunity to request information about the professional qualifications of classroom teachers and paraprofessionals instructing their child.
Parents/Guardians:
In accordance with the Parents Right-to-Know requirement under the Every Student Succeeds Act, every parent or guardian of a student attending a Title I school is notified of the right to request and receive in a timely manner the following:
- Information regarding the professional qualifications of your student’s classroom teachers. The information regarding the professional qualifications of your student’s classroom teachers shall include the following:
- if the teacher has met state qualification and licensing criteria for the grade level and subject areas taught;
- if the teacher is teaching under emergency or temporary status in which the state qualifications and licensing criteria are waived;
- the teacher’s baccalaureate degree major, graduate certification, and field of discipline; and
- whether the student is provided services by paraprofessionals, and if so, their qualifications.
- Notification if your student has been taught for four or more consecutive weeks by a teacher who does not meet the applicable state certification for licensure requirements at the grade level and subject area in which the teacher has been assigned.

Survey Information
School Bus Cameras
The Beaufort County Board of Education has authorized the use of video cameras on school district buses. The district will use the video cameras to monitor student behavior in order to maintain a safe environment. Students and parents/legal guardians are hereby notified that the content of the videotapes may be used in a student disciplinary proceeding. The content of the videotapes is a confidential student record. The district will retain the videotapes with other student records only if necessary for use in a student disciplinary proceeding or other matter as determined by the administration. Parents/Legal guardians may request to view videotapes of their child if the district uses the videotapes in a disciplinary proceeding involving their child.

INFORMATION REGARDING SECTION 504 OF THE REHABILITATION ACT OF 1973 &
NOTICE OF PARENT AND STUDENT RIGHTS UNDER SECTION 504
Section 504 is an Act that prohibits discrimination against persons with a disability in any program receiving Federal financial assistance. It assures that persons with disabilities have educational opportunities and benefits equal to those provided to non-disabled students. The Act defines a person with a disability as anyone who:
(1) has a mental or physical impairment which substantially limits one or more major life activities (such as caring for one’s self, performing manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working); (2) has a record of such impairment; or (3) is regarded as having such an impairment.
In order to fulfill its obligation under Section 504, Beaufort County School District recognizes a responsibility to avoid discrimination in policies and practices regarding its personnel and students. No discrimination against any person with a disability will knowingly be permitted in any of the programs and practices in the school system.
The Beaufort County School District has specific responsibilities under the Act, which include the responsibility to identify, evaluate, and, if the student is determined to be eligible under Section 504, to afford access to appropriate educational accommodations.
If the parent or guardian disagrees with the determination made by the professional staff of the Beaufort County School District, he/she has a
right to a hearing with an impartial hearing officer.
The Family Educational Rights and Privacy Act (FERPA) also specifies rights related to educational records. FERPA gives the parent or guardian
the right to (1) inspect and review his/her child’s educational records; (2) make copies of these records; (3) receive a list of all individuals having
access to those records; (4) ask for an explanation of any item in the records; (5) ask for an amendment to any report on the grounds that it is
inaccurate, misleading, or violates the child’s rights; and (6) receive a hearing on the issue if the school refuses to make the amendment.
Section 504 provides parents and students with the following rights:
- The right to be informed of your rights under Section 504 of the Rehabilitation Act.
- The right for your child to have equal opportunities to participate in academic, nonacademic, and extracurricular activities in your school.
- The right to be notified about referral, evaluation, and programs for your child.
- The right for your child to be evaluated fairly.
- The right for evaluation, educational and placement decisions concerning your child to be made based upon a variety of information sources and by a team of persons that includes persons who know the student, the evaluation data, the placement options, and the legal requirements for least restrictive environment and comparable facilities.
- The right, if eligible for services under Section 504, for your child to receive accommodations, modifications, and related services that will meet his/her needs as adequately as the students without disabilities.
- The right, if eligible for services under Section 504, for your child to receive a periodic reevaluation.
- The right for your child to be educated with peers who do not have disabilities as much as possible and for him/her to use facilities and participate in services and activities that are comparable to those provided for non-disabled students.
9. The right to request changes in the educational program of your child.
10. The right to review and obtain copies of your child’s school records.
11. The right to file a grievance on Section 504 issues other than your child’s identification, evaluation, and placement; to file a grievance, make a grievance request in writing and send it to the District Section 504 Administrator (Mrs. Leah Greco, Lead School Psychologist, Student Services Department, Beaufort County School District, P.O. Drawer 309, Beaufort, SC 29901); the District Section 504 Administrator shall investigate the grievance and reply in writing within ten (10) business days.
12. The right to an impartial hearing if you disagree with the school regarding your child’s identification, evaluation, or educational placement; to initiate an impartial hearing, you must file a written Notice of Appeal with Dr. Chad Cox, Student Services Officer, Beaufort County School District, within 10 calendar days from the time you received written notice of the Section 504 committee’s actions. A hearing will be scheduled before an impartial hearing officer within 30 calendar days, and you will be notified in writing of the date, time, and place for the hearing. If you disagree with the hearing officer’s decision, you have a right to a review of that decision by a court of competent jurisdiction.
13. The right to request attorney fees related to securing your rights under Section 504.
14. The right to file a complaint with the Office of Civil Rights. The Regional Office of Civil Rights which has jurisdiction of South Carolina can

15. The right to file suit directly in any court of competent jurisdiction alleging a violation of Section 504.

DISTRITO ESCOLAR DEL CONDADO DE BEAUFORT INFORMACIÓN SOBRE LA SECCIÓN 504 DE LA LEY DE REHABILITACIÓN DE
1973 Y AVISO DE DERECHOS DE PADRES Y ESTUDIANTES BAJO EL PLAN DE LA SECCIÓN 504
El Plan de la Sección 504 es una ley que prohíbe la discriminación contra las personas con discapacidad en cualquier
programa que reciba asistencia financiera federal. Garantiza que las personas con discapacidad tengan las mismas oportunidades y beneficios educativos que los estudiantes sin discapacidad. La ley define a una persona con discapacidad como cualquier persona que:
(1) tiene un impedimento mental o físico que limita sustancialmente una o más actividades importantes de la vida
(como cuidarse a sí mismo, realizar tareas manuales, caminar, ver, oír, hablar, respirar, aprender y trabajar); (2) tiene
antecedentes de dicho impedimento; o (3) se considera que tiene dicho impedimento.
Para cumplir con su obligación bajo el Plan de la Sección 504, el Distrito Escolar del Condado de Beaufort reconoce su
responsabilidad de evitar la discriminación en las políticas y prácticas relacionadas con su personal y estudiantes. No se
permitirá, a sabiendas, la discriminación contra ninguna persona con discapacidad en ninguno de los programas y
prácticas del sistema escolar.
El distrito escolar tiene responsabilidades específicas bajo la Ley, que incluyen la responsabilidad de identificar, evaluar
y, si se determina que el estudiante es elegible bajo la Sección 504, brindar acceso a adaptaciones educativas
apropiadas.

El derecho a que las decisiones sobre la evaluación, la educación y la ubicación de su hijo/a se tomen con base en diversas fuentes de información y por un equipo de personas que conozca al estudiante, los datos de la evaluación, las opciones de ubicación y los requisitos legales para un entorno menos restrictivo e instalaciones

6. El derecho, si cumple los requisitos para recibir los servicios del Plan de la Sección 504, a que su hijo/a reciba adaptaciones, modificaciones y servicios relacionados que satisfagan sus necesidades de la misma manera que las de los estudiantes sin discapacidades.
7. El derecho, si cumple los requisitos para recibir los servicios del Plan de la Sección 504, a que su hijo/a reciba una reevaluación periódica.
8. El derecho a que su hijo/a reciba educación con compañeros sin discapacidades en la medida de lo posible y a que utilice las instalaciones y participe en servicios y actividades comparables a los que se ofrecen a los estudiantes sin discapacidades.
9. El derecho a solicitar cambios en el programa educativo de su hijo/a.
10. El derecho a revisar y obtener copias del expediente escolar de su hijo/a.
11. El derecho a presentar una queja sobre asuntos del Plan de la Sección 504 que no sean la identificación, evaluación y colocación de su hijo/a. Para presentar una queja, presente una solicitud por escrito y envíela a la Administradora Distrital de la Sección 504 (Sra. Leah Greco, Psicóloga Escolar Principal, Departamento de
Servicios Estudiantiles, Distrito Escolar del Condado de Beaufort, P.O. Drawer 309, Beaufort, SC 29901). La Administradora Distrital de la Sección 504 investigará la queja y responderá por escrito dentro de los diez (10)
días hábiles.
12. El derecho a una audiencia imparcial si no está de acuerdo con la escuela con respecto a la identificación, evaluación o colocación educativa de su hijo/a. Para iniciar una audiencia imparcial, debe presentar una Notificación de Apelación por escrito ante la Dr. Chad Cox, Oficial de Servicios Estudiantiles del Distrito Escolar del Condado de Beaufort, dentro de los 10 días calendario siguientes a la recepción de la notificación por escrito de las acciones del comité de la Sección 504. Se programará una audiencia ante un oficial de audiencias imparcial dentro de los 30 días calendario, y se le notificará por escrito la fecha, hora y lugar de esta.
